E-Verify Program
The basic steps employers must follow are:
- Enroll in the e-Verify system with the Department of Homeland Security
- Make sure all employees who will administer the program for the employer have completed the E-Verify Computer Based Tutorial (click here).
- Post both the notice from Homeland Security indicating that the employer has enrolled in the basic pilot or e-verify program, and the anti-discrimination notice issued by the Department of Justice in a prominent place.
- Within 30 days of the effective date of the new Illinois law (which means by the end of January 2010), the employer must attest on a form provided by the Illinois Department of Labor (click here to download) that the employer and his/her employees who will be using the system have taken the training.
There are some other items employers should be aware of that are outlined in the Illinois statue (click here). Again the Illinois statute takes effect January 1, 2010, but the federal requirement is already in place.
